My country does not have a notion of "rule of law". The constitution is a patchwork BS with "stato di diritto", which mimicks poorly "rule of law". My culture does not know what is a "human right" its a concept alien to the italian culture. Stato di diritto is not rule of law. The anglo rule of law is a bottom-up philosophy that is born from the magna carta and various wars. The big idea is the individual possesses the state.
The individual gives "a mandate" to the state. The law in angloland is the idea to protect the citizen FROM the state.
In continental law, this isnt it. We are much closer to a slav or a russian, we are slaves. Stato di diritto is a patchwork, it is top-down philosophy fundamentally different from rule of law. It comes probably from roman law and various napoleonic wars or I dont know where. Point being you dont get to have "natural rights" this concept is ALIEN in italian culture.
You get rights granted to you by the protectorate you are under. State gives you codes and rules. This is the opposite, the state gives a mandate TO YOU. In other words, you are owned, your bitch ass is owned by the state.
Because the State gives you your rights, the State can take them away. This is also the reason why italy is horribly communist, its the largest communist assembly in the west. And if we are not communist we are fascist.
From abroad, they dont know how far the values of the avg italian guido are from american ones. Which is why when they did the mistake of importing italians for slave labor, they found themselves full of a mafia infestation.
